Research On The Legal System Of The Movement Of Natural Persons Under The Framework Of GATS

Movement of natural persons is one of the four offered service modes under the GATS agreement.That is,a natural person members of the service providers to the existent of natural person offer services in the territory of any other members. Economists' research shows that the liberalization of movement of natural persons will increase world welfare.However,in four modes,the movement of natural persons is the lowest level of commitment.Meanwhile,it meets more obstacles in the practice.As a result,it slows the process of liberalization.But at the same time it also shows that it has greater growth potential.To promote the liberalization of the movement of natural persons is an inevitable requirement of the development of international trade in services and global economic integration.As a result,since the Doha Round negotiations,all members,particularly developing members and least undeveloped members,are concerned about the movement of natural persons.In addition to the introduction and conclusion,this article is divided into four parts.The first part is the concept and scope of movement of natural persons.It briefly analyses some of the major basic definition of the movement of natural persons,and through this,we distinguish it with the other three modes of trade in services, immigration and other relevant concepts to further a clear connotation and denotation of movement of natural persons.The second part is the motif and rule of law for movement of natural persons under the framework of GATS.Mainly through getting known to the negotiation history of movement of natural persons,we definite the motif of movement of natural persons under the framework of GATS and we sum up the specific legal rules and specific commitments by countries under GATS framework.The third part is taking about the barriers for furthering the liberalization of movement of natural persons under the framework of GATS.This part summarizes the legal definition defect and the lack of specific commitments of movement of natural persons under the framework of GATS.At the same time,it generalizes the barriers to movement of national persons in the practice and has done a simple analysis of causes of relative barriers set by each country.The fourth part clarifies the elimination of the barriers of movement of natural persons under the framework of GATS and illustrates the improvement with the relevant provisions.According to the foregoing analysis,I promote my own thinking and proposals about how to push the further liberalization of movement of natural persons under the framework of GATS,such as improve the commitments' structure,the adoption of GATS visa,perfecting certification and complementing security measures and so on.
