The Research On The Mechanism Of Penalty Dishonesty In China's Credit Reporting System

The mechanism of penalty dishonesty is defined as a mechanism that the relevant institutions all participate, based on the information database of enterprise and individual credit ,comprehensively using legal, administrative, economic and moral means. In the mechanism, those who are dishonest will pay a great deal of the corresponding economic costs and reputation costs until they are forced out by the market.In this way, the interests of the honest are safeguarded.The mechanism is set to create incentives for the honesty. The socialist market economic of China is still not perfect. To establish and improve the social credit environment where people observe discipline and abid by the law,trade fairly and be honesty require a process. Therefore ,it is urgent to build the mechanism of penalty dishonesty.During the process of economic transaction, one of the most important reasons for the occuring of dishonesty is lack of the social credit constraint mechanism. Only to build a mechanism of penalty ,can we punish and combat the dishonest activities in the market economy. In a word, it is necessary to build the mechanism of penalty dishonesty.Firstly, the paper studies deeply and comprehensively the status quo and existing problems of the mechanism of penalty dishonesty in our country, and reveals that the main reasons for the imperfect mechanism of penalty dishonesty are that the lack of credit concept, the lag of legal system construction, the credit information is not guaranteed, the unscientific credit institutions, the absence and overrun of administration departments in our country etc. Those provide much experience and reference to build the mechanism of penalty dishonesty; Secondly, this paper theoretically analyzes the influencing factors of the credit environment in our country by using the mathematical statistical methods. It indicates that the imperfect mechanism of penalty dishonesty hampers the continual development of the credit environment in our country, which further points out the necessity and urgency of establishment and improvement of the mechanism of penalty dishonesty from the empirical view. Furthermore from the cost-benefit analysis, institutional economics and game theory perspective separatly, we economically analyze the establishment of mechanism of penalty dishonesty in China. And find out that the economic foundation of the mechanism of penalty dishonesty is to combat dishonesty, encourage faith and provide theoretical support to build the mechanism of penalty dishonesty. Based of the above analysis, we suggest a way to build the basic content, the overall framework, the operation mode of the mechanisms of penalty dishonesty. Finally, after summarizing the successful experience of the credit countries who run the mechanism of penalty dishonesty and combining with the status of our country's mechanism of penalty dishonesty, we propose the advices and countermeasures to improve the mechanism of penalty dishonesty in our country.
