The real estate brokerage is an important component of real estate intermediary service industry, and it plays more and more important part with the development of real estate industry. But a number of problems have arisen while the real estate brokerage developing quickly. In order to solve these problems, some scholars and practicing persons started to research the wonderful brokerage theories in America and tried to use them for reference. However, it didn't work well because these theories were not researched systemically, the essences of these theories were not caught, and, the feasibility of applying it in our country wasn't analyzed, too.Preface puts forward the concept of brokerage's operating mode including three aspects: activity mode, management mode of agent, business mode of agency, and this article will take it as the research object to analyze its differences between China and America. The preface also defines content of some concepts in order to speak with one voice, and it introduces the quoted theory, way of study and innovation of this article.Chapter two contrasts and analyzes the information sharing mode's connotation between China and America. The MLS in America and three types of information sharing in China were analyzed mainly.Chapter three contrasts and analyzes the activity mode's connotation and cause of formation between China and America from two aspects: agency mode and contract mode. It also analyzes their effect according to study the brokerage activities of new houses sale mode, existing houses sale mode and FSBO.Chapter four contrasts and analyzes the management mode of agency between China and America from three aspects: the relationship between agency and agent, commission distribution system, and taxation system. The independent contractor which has two different connotations between China and America is studied mainly.Chapter five contrasts and analyzes the business mode of agency between China and America, and both of them have three business modes: single mode, company-owned chain mode, and franchise mode. However, century 21, the representative of franchise mode changes into the mode company-owned chain and franchise develop simultaneously in order to suit for the local characteristics in China.Chapter six analyzes the inspiration of American mode for China from three aspects: the relationship between agent and client must be fiduciary, not intermediary; independent contractor hasn't advantages to develop in China at the present time; the company-owned chain mode is the main mode agencies use, and the franchise mode will instead of it in the future.
