Problem Studies On Illegal Land Use Of Rural Tourism Exploitation

With the development of tourism and change of customer demands, a new type of tourism—rural tourism come into being. Besides positive effects, it brings negative effects, including illegal land-use. The existence of illegal tampers with the sustainable development of rural tourism. Exploitation of rural tourism cannot part from land, it is the carrier of rural tourism. Land resources of China are scarce, so legal and efficient to use land is the insurance of rural tourism exploitation. So it is necessary to analyze the phenomena of illegal land use in rural tourism exploitation, dig the causations, find the measures to resolve the problem.The major methods of this research are document summarization,outside survey,cases analysis and combine of qualitative analysis and quantitative analysis. Firstly ,analysis the basic information to confirm the main bodies of illegal land-use,the relationship among the main bodies,the forms of illegal land-use and the differences from common illegal land-use. Secondly, apply economics theories to analyze the main harms to the sustainable development of rural tourism, including destroying the earth resource and rustic quality of rural tourism, impairing the farmers' fundamentality rights and interests, increasing the social cost, and so on. Thirdly , apply bureaucracy economic theory to confirm that local government illegal use land by the reason of seeking maximize benefit under present performance-assess-system ;villagers' committee illegal use land by the main reason of departure of originally function; the main reason of rural tourism developers' illegal land use is seeking the interest from the rural tourism exploitation. Besides, defect of law and system, relaxed of execution the law and problems of rural tourism itself cause the illegal land use in the rural tourism to happen. Fourthly, combining public law and private law to regulate government' and villagers' committee's power; using government regulation to avoid developer illegal land use, make rural tourism canonical and continual development.
