| Land expropriation system is a legal system that countries design to develop public interest. The land ownership of china is divided into the state ownership of land and the rural collective ownership of land. In China,the government expropriate the land of the rural collective and transform the land of the rural collective into state-owned land through certain procedures,based on the need of the public interest. But the current land expropriation system in China has many defects,making land expropriation disputes endless. It is a focus of sociaty that how to improve the land expropriation system to resolve conflicts between the demand of land for national economic construction,farmland protection and food security,and the right and benefit of farmers ect. In this paper,after analyzing the evolution of china's land expropriation system, the author analyse the defects of the current land expropriation system and try to put forward sound proposals on how to improve the land expropriation system.The structure and the content of the paper are as follows:The first part of the paper mainly studies the trends and the impact of the evolution of china's land expropriation system, and analyzes its causes through reviewing the evolution of china's land expropriation system.The second part of the paper mainly studies the defects and limitations existing in the current land expropriation system, the defects and limitation on the discord between the procedure design of land expropriation system and the compensation standard of land expropriation system have been analyzed institutionally, based on the practice of land expropriation in China.The third part of this paper puts forward some proposals on the improvement of land expopriation system in China. Some suggestion for improvement of the system model selection, expopriation procedures and compensation standard of land expopriation have been offered according to methodology of comparative law, combined with national condition in China... |
