Study On The Law Of Sustainable Development Of Resource-based Cities

With the development of resources, resource-based cities which the leading industry is resources exploitation is rising. Resource-based cities have provided main production material, huge profits and taxes for our country in socialist construction. Becouse of the development of resource-based is increased continuously with the establishment of the socialist market econmy, the social benefits and environment protection are ignored by market subject and resources shortage, ecological destruction, environment pollution is increaslingly serious. Facing the new situation that resources shortage is further intensified, the survival and development of resource-based cities not only exist new challenges, but also directly related the sustainable development of urban system and even country. Therefore, the discussion and research on sustainable development of resource-based cities has important practical significance and profound historic significance.The sustainable development of resource-based cities must be protected by law. China has formed relatively complete legal system of sustainable development of resource-based cities basically, which the constitution is core; the enviromental protection law is basic law; the main content of law related sustainable development of resource-based cities; the international treaties and conventions related sustainable development of resource-based cities which China has concluded. However, the legislation, enforcement, responsibility and supervision of sustainable development of resource-based cities in China still exist some problems which should be established and perfected furtherly. The legal system of sustainable development of resource-based cities in china is facing serious challenge. In order to implement the strategy of sustainable development, the law and regulations of sustainable development of resource-based cities must be modified and perfected to meet the need of sustainable development strategy. In this paper, the guidance is sustainable development; the mainline is the problems which appear in the proces of sustainable development of resource-based cities in China; the purport is the legal research of sustainable development of resource-based cities. This paper study depthly on the problems of law and policy which appear in the process that the cities seek the sustainable development. To realize the sustainable development of resource-based cities, we must improve the environmental legislation, strict environmental enforcement, strengthen the law enforcement supervision, straighten out management system and enhance the government's responsibility. Firstly, this paper analyzes the current situation based on the prolems of resource-based cities and proposes that the industrial structure is single; the destruction of ecological environment is serious; there is no long-acting mechanism of sustainable development; the situation of talent shortage and employment pressure. It points out that the resource protect and urban development must be combined, and analysis the predicament and restrictive factors with the value of sustainable development in the process of sustainable development of resource-based cities in China, as well as points out that the resource-based cities in China must take the road to sustainable development. The value of sustainable development has the special significance for resource-based cities, and the sustainable development of resource-based cities must be guaranted by law. This paper plays a foreshadowing role for the legal research of sustainable development of resource-based cities. Secondly, this paper puts forward the problems of legal construction on the sustainable development of resource-based cities from legislation, enforcement, responsibility and supervision etc from actual conditions, which provides basis for find countermeasures and suffestions comprehensively. This paper summarizes the experience of sustainable development of resource-based cities abroad to make theories more specific. Finally, this paper proposes the measures and suggestions that make the resource-based cities realizing sustainable development based on the problems analysis and experience reference. And it puts forward some suggestions from perfecting legislation, enhancing execution, clearing responsibility and strengthening supervision, etc to realize the sustainable development of resource-based cities.
