Research Of Land Tenure System Reform In Industrialization Of China

After the founding of the People's Republic of China, it has been entered the stage of industrialization, since the reform and opening up, the pace of industrialization had been accelerated, agriculture and non-agricultural land issue had become a focus of people, land tenure system had become an important factor in the process of industrialization. This paper use the theory of property rights, by analyzing peasant's land property rights, land expropriation system and the model of participation in land tenure system in industrialization, it believes the land leasing system is the best choice for land tenure system. The main points of this paper include:(1) After 1949, the land rights of peasants had been changed from completely private ownership to completely non-proprietary, and then to incomplete property rights, in other words, the land property of peasant had been developed from clear property rights to unclear rights, and then to clear rights again; Land expropriation experienced from paid to unpaid for compensation, and then to paid again.(2) By analyzing the land expropriation system and the model of participation in land tenure system, it believes that land leasing system can protects the interests of land owners, and also benefits to the process of urbanization and industrialization.(3) Based on the useful experience of developed countries and regions, it presents three proposals: firstly, it must be reasonable to define the scope of public interest; secondly, it must be defined the legal procedure of land expropriation; thirdly, it must be scientifically, reasonably and fairly determinate compensation standard of the land expropriation.
