The Study On Fairness And Efficiency Of The System Of Rural Housing Sites

Maintaining social stability as the value of system designing, the current system of rural housing sites is established on the foundation of peaseants'living security .The system marked by features of specific group ,land provided free, uncertain land tenure and the strict limit of land transfer. The relevant issues of rural housing sites is discussed and analyzed here from the two aspects between fair and efficiency based on the relevent survey and proposals for system reform is put forward.We make a summary on the research done in the system of rural housing sites from three aspects of land acquisition, land use and land trasformation at first and continues with dividing the development periods of land transformation which includs the stage of free flow, the stage of prohibiting flow, the stage of urban residents owning rural land, the stage of limiting flow. And then the paper makes a concrete analysis of historical background at every period, which is made an conclusion that transformation of rural housing sites related to political ,economical and social conditions of a given society. Importantly,we have summed up that the system marked by features of conditional users, limited right,free use and free acquisition and uncertain land tenure. At last, relying on the analysis above, we generalize the function of the current system of rural housing sites: security, distribution equity, maintaining social stability and cultivated land protection.With regard to the two aspects between fair and efficiency in the system of rural housing sites ,This paper begins with their connotation, their relation and the illustration which our government has made at the present stage. In view of these statement above, we analysed fair and efficiency in the current system of rural housing sites. On the one hand ,that the ownership of rural housing sites can not trasform leads to inequality in respect of the development rights and security rights between urban and rural residents, which intensifies the disparity of the two groups. On the other hand, on account of rural housing sites provided free as well as its feature of non-transformation, a great deal of rural land leave unused ,which is in sharp contrast to pressed urban land. the phenomenon is not conducive to arable land protection and intensive land use .Certainly ,it also obstacle to balance urban and rural development. Finally, the author of "small property" issue for the object, that is the source of the problem urban and rural land system, the farmers land rights have been infringed or denied in fact, into a summary that existing system of rural housing sites neither is fairness, not any realization of efficiency.Based on the discussion above and our survey , we make an analysis on the sucessful reform pattern of the system of rural housing sites in our country in the case of the suggestion of system reform.After that, we put forward a series of suggestions based on the principle of fair and efficiency which include the following: performing severe scheme of the acquisition and procedures for examination; perfoming a prescribed period of use, performing the system of rural land use combinating acquisition free or not; rural housing sites fair and efficiency in the circulation system, the theoretical analysis and puts forward specific measures and recommendations ,performing the system of lifting the control over land transformation gradually. We hope these suggestions can play a part in developing an intergrated land market between urban and rural areas.
