Bidding is a fair and free competition in the market system. However, once the collusive behavior is involved, it will fundamentally change the nature of bidding. Bidding collusion is an illegal behavior which seeks high profits through the limitation of competition. The bidding collusion is not only a serious infringement of the relevant market and the legitimate interests of the main competition, but also undermines the order of fair and free competition. It is very harmful to the market. However, there are few full-scale researches on the bidding collusion uttered in the native academia. This thesis studies the bidding collusive behavior in a comprehensive manner, and supplies a theory foundation for the restriction of the bidding collusion. The aim of this study is to seek some effective measures to beat the bidding collusive behaviors and the research will work positively for the healthy development of the relative bidding laws.This paper firstly introduces the bidding collusion from the concepts, characteristics, etc. Bidding collusion is a kind of behavior to limit the fair and free competition of some transaction field in order to get high profits. Meanwhile, this paper makes a deep analysis of the nature of the bidding collusion from the perspectives of Economics and Law, and analyses the causes of bidding collusion, such as rule defects, poor supervising etc. Compare to the advanced countries, there are still many problems which need to solve, such as imperfect regulations, the ambiguous definition of collusion in bidding behavior and so on. These problems in varying degrees lead to the occurrence of bidding collusion. Finally, this paper establishes the countermeasures in detail to the bidding collusion behaviors.
