Research On The Phenomenon And Governance Mechanism About Horizontal Collusion In The Bidding Field Of Construction Projects

In China, implication of the bidding system since the 80s of the 20th century promotes fair and free competition, however, irregularities in the bidding such as bid-rigging, collusion, circumvention of bidding, false tender, "black and white contract" seriously disturbs the market order.The dissertation takes horizontal collusion among the bidders for the research object, chooses identification and prevention of collusion as the main research questions.Analyse the causes,hazards, common form, affecting factors,establish standards for the identification of horizontal collusion,and propose recommendations for governancing horizontal collusion. In the course of the study, uses literature review method, AHP method, game theory, questionnaire survey, expert scoring and other research tools and methods.The dissertation introduces governance theory into the prevention of horizontal collusion to build governance mechanism for horizontal collusion.First, using literature interview method, analyse horizontal collusion from the causes, influencing factors, the nature of collusion, and the forms etc., to pave the way for identifying and establishing countermeasures for horizontal collusion in later chapters. The study indicates:interests' induction, defective of bidding system as well as imperfect external systems lead to emergence of horizontal collusion, in which the decisive factor is the income of collusion is greater than the cost of collusion.Second, use literature collection, questionnaire survey, expert scoring, and AHP method to establish identification standards for horizontal collusion. Obtain the initial identifying standards through collection of the literature and local regulatory documents, design survey questionnaire to further screen criteria, and use expert scoring, AHP method to get the weight of standards. Get the probability of collusion and different procedure for identified cases.Third, use literature review and theoretical interpretation to select and design governance path for horizontal collusion. Build the governance mechanism from the governance level and root cause of horizontal collusion. By improving the bidding system, encouraging the agency tender/evaluation experts to investigate and deal with collusion, in order to achieve internal governance.By improving the bidder's reputation mechanism and strengthening the supervision as well as punishment, in order to achieve external governance. Eventually, achieve the purpose of increasing collusion costs, reducing collusion income, and restrain the horizontal collusion.At last, balance whether or not governance collusion, avoid excessive regulation and the inefficiency of tendering, in order to reduce unnecessary losses.
