| Sports tourism is the country's rapid development of emerging industries, which not only promoted the development of local economic development, broaden employment channels, enrich people's economic and cultural life, but also enhances the quality, effective promotion of the National Fitness promotion. With the sports tourism in Shaanxi rapid development of all related legal problems emerged, the current laws and regulations of Sports Tourism is not sound, limiting the sustainable development of Sports Tourism. However, a good legal environment is a strong guarantee for the development of sports tourism and premise. In this paper, the development of sports tourism in Shaanxi Province to study the legal environment, the use of literature, social surveys, expert interviews, field observation, logical analysis, the study, the theoretical knowledge combined with the reality of Sports Tourism Development Analysis of the situation.The content of this research is the first of the legal environment of Sports Tourism Situation Analysis carried out to identify the shortcomings of them put forward their own proposals. But, the fine legal environment is a forceful guarantee and premise that the sports tour develops. The current situation being in progress first to Shaanxi sports tour legal environment analyses the thesis go into content , finds out existence among them deficiency , the suggestion bringing forward self. Purpose to enhance and improve the legal environment for the future development of Sports Tourism, strengthen the rule of law, in a regular Shaanxi, the scientific management of this emerging industry and to promote their healthy development, to achieve that there are laws is strictly enforced, illegal must study the legal environment in which the province's sports tourism industry took legal basis for sustainable development. The results show that:(1).Sports Tourism in Shaanxi existing legal system is not perfect, less systematic, it can not meet the need. China has no one dedicated to national development of sports tourism, fundamental principles and measures to make the provisions concerning the long-term development of sports tourism specific legislation or guidance documents, such as "sports tourism development plan," and so on, are not Sports tourism industry in this special issue of the existence of specific legislation and planning guidance, on the sports tourism industry involved in all aspects of the legal relationship and adjustment to make effective binding laws and regulations, is not conducive to adjust the sports tourism industry and related industries interests, thus limiting the sports tourism activities, the regulation of the operation between the main relations.(2)Sports Tourism flawed law enforcement system, law enforcement agencies set up scientific, law enforcement agencies of duties unreasonable method operation mechanism is not smooth. The results of these issues affect the effectiveness of law enforcement, because law enforcement system defects affect the overall legal environment for the healthy development of sports tourism law enforcement and the lack of legislation, law, legal supervision and positive interaction.(3)Judicial intervention of Sports Tourism is still in the exploratory stage. Touring the public rarely resolved through legal proceedings took place among the sports tourism issue, most cases are resolved through the internal private mediation agreement. This is because there are no clear laws and regulations, after a dispute in the travel process is difficult to solve, even if the prosecution, the court only in accordance with general principles of civil law division of responsibilities. Shaanxi sports tourists to Laws, because our citizens have long been planned economy, culture and other factors limiting the impact of weak legal consciousness. Sport tour operator's legal awareness and safety awareness is not strong, sports tourism manager of the legal management of pay enough attention, and sports tourism consumers know how to use legal means to protect their legitimate rights and interests.(5) Sports Tourism legal supervision mechanisms are inadequate.
