Research On Shanxi Rural Drinking Water Pollution Prevention Legal System

Chinese Communist Party proposes the basic strategies which aims to strengthenthe construction of ecological civilization and the rule of law in eighteen report, placingthe construction of ecological civilization with economic, political, cultural and socialconstruction on the same level, and considers the construction of ecological civilizationas an important policy of the people’s livelihood, and emphasizes that saving resourcesand environmental protection are very important. At the same time, Chinese CommunistParty and the state build the rule of law, implement the rule of law, and perfect thesocialist legal system in order to ensure the "scientific legislation, civilized enforcement,judicial justice, and security compliance" to try to perfect the socialist legal system fromvarious aspects. The thesis puts forward the ideas of perfecting the legal system in thissocial context, combining with the present situation of rural drinking water pollution inShanxi.With the pace of China’s economic development forward, China’s economy hasentered a new level. As people’s living standards rise, they are increasingly concernedabout environmental requirements. As a province with rich coal resources, Shanxi takesthe energy economy as the main mode of economic development, which has led to theeconomic development, supported the national construction and made the residents’income increase. At the same time, it also brings environmental pollution, especiallywater pollution. After a series of regulations are issued to protect water resources, waterpollution in a way has been restrained in Shanxi Province. But the prevention ofpollution of drinking water in rural areas is defective, which has made thecontamination of drinking water aggravate in Shanxi rural areas in recent years,especially safety of rural drinking water in the mining areas is seriously threatened. Thisthesis considers that it is necessary to perfect legal system of rural drinking waterpollution prevention for the realization of the scientific concept of development,sustainable development and new rural construction, urban-rural integration and the realization of farmers environmental justice by surveying the current situation of therelevant legislation in Shanxi Province and the situation and the reasons for Shanxi ruraldrinking water pollution, combining with the relevant domestic legislation andinternational legal construction of water. At the same time, this thesis also considers thatit is feasible to improve legal system of rural drinking water pollution prevention for thebasic national policies of the construction of ecological civilization and the rule of lawas political and social background.While this thesis analyzes the rsasons such as agricultural non-point sourcepollution and domestic water pollution which lead to Shanxi rural drinking waterpollution, it also emphasizes rural drinking water pollution prevention in the miningareas. And it thinks that security risk of Shanxi rural drinking water attributes to coalmining and imperfection of the government’s regulatory system. Shanxi Province shouldlegislate comprehensively, perfect the regulatory system and public participation andlitigation during controlling the rural drinking water pollution. Perfecting legal systemof rural drinking water pollution prevention in Shanxi contributes to perfect China’ssocialist legal system, which gives suggestions to ensure that the rural residents candrink safe water in Shanxi.
