Research On Legal Countermeasures Of Rural Water Pollution Prevention And Control In Guizhou Province

Water is the source of human life, in real life, however, the situation of water pollution is our concern. A large number of industrial waste water discharge into the environment without any treatment, and life sewage of residents, dumped trash, chemical fertilizers and pesticides used so much in agricultural production, they cause a great damage to water environment. But on the problem of water pollution, our country pays more attentions to cities than rural areas and so does Guizhou province. Under the background of the construction of ecological civilization, the work about rural water pollution prevention in Guizhou should also keep up with the pace of the city, especially when facing the present situation of the heavy water pollution in rural areas, it is significant in practical to put forward to corresponding countermeasures of rural water pollution problems from the point of law.In this paper, four chapters are arranged to study the law measures of Guizhou rural water pollution prevention and control. The first chapter makes a general overview of rural water pollution, so that we can get an overall understanding about the situation of rural water environment, especially for rural water pollution situations, the source of water pollution and so on. By collecting related data and materials about water pollution and analyzing them,Then analyses the situations of rural water pollution prevention and control in Guizhou Province, and summarizes the achievements and shortcomings from two aspects of "prevention" and "control", so that to make an appropriate bedding to put forward to measures and improve the pertinence of measures.The second chapter is mainly about the analysis of defects in rural water pollution prevention law in Guizhou. It focuses on the defects of water pollution prevention in legislation, law enforcement, judicial and citizens’ law consciousness and so on.The third chapter takes some countries as samples, such as the United States, Japan, and Sweden, and studies them to summarize some actual experience from the water pollution prevention law, which can be applied in rural water pollution prevention and control in Guizhou.For example, making some laws supporting systems, include the local standards on using of chemical fertilizer and pesticide, so that to enhance the operability of law, and strengthening the public participation system, so that we can avoid detours and improve the level of water pollution prevention and control in Guizhou. For example, for the rural water pollution issues caused by agricultural non-point source pollution, solid waste, we can develop some special measures for pesticide; fertilizer use and solid waste treatment to guide the rural residents use fertilizers, pesticides, and handle the solid waste properly and reasonably, and gradually reduce the pollution of rural water environment from the source; we can also strengthen the public participation system to avoid many detours in the rural water pollution prevention and control of Guizhou Province, so that to improve the level of the prevention and control of water pollution.The last chapter is mainly to put forward to some practical legal measures in rural water pollution prevention and control, it mainly from the legislative, law enforcement, judicial and environmental protection consciousness and responsibility of citizens and enterprises, such as perfecting the legal system, formulating “Regulations on prevention and control of water pollution in rural areas of Guizhou province” as well as the detailed supporting standards for water environment, intensifying law enforcement and regulation in the water pollution prevention, strengthening the environmental justice to ensure the realization of tort relief, making the rights and obligations between citizens and the enterprise itself clear and so on. According to the discussion of these strategies, the author hopes to make a contribution to the rural water pollution prevention and control work in Guizhou, and promote the further perfect and development of environmental law in Guizhou.
