Study On Legal Problems Of Prevention And Control Of Non - Point Source Pollution In Rural Areas Of China

In recent years, rural economy has developed by leaps and bounds with the constantly upgrade of the modernization level and the degree of intensification in agriculture (planting, animal husbandry and aquaculture industry). The material life and spiritual civilization life standards of rural residents have improved greatly. However, with the rapidly development of rural economy, rural non-point source pollution is becoming more and more serious. Not only the abuse of fertilizer, pesticide, agricultural film and the other agro-chemicals, but lack of effective and on time processing mechanism to deal with the rapid increase in livestock manure, straw, rural domestic refuse and the other waste has caused varying degrees of pollution on soil, water and air. Rural non-point source pollution has become the leading cause of rural environmental pollution in China. It has bring negative influence to rural ecological environment, which is endangers not only health and quality of life in rural residents even city dwellers, but also the country’s food supply security. It has serious restricted the sustainable development of agriculture, rural areas and farmers. It is a long-term, complex and arduous project on preventing and controlling rural non-point source pollution. Any interim and project policies and measures can not really solve this problem. If you want to find a fundamental solution, you must devote tireless efforts and rely on legal, administrative, economic, technical and all kind of comprehensive measures. Among all of them, improving and perfecting legal system is the best way and key issue. The establishment of effective legal mechanism is imperative.Based on the present situation analysis of rural non-point source pollution, this paper focuses on existing problems and puts forward some countermeasures on preventing and controlling rural non-point source pollution in China from improving and perfecting relevant environmental legal system perspective. There are five chapters in this paper as following.Chapter one is introduction. This article’s foreword elaborates the significance and background of the article research. It also describes the research situation of rural non-point source pollution in the world and innovation of this paper.Chapter two is the definition of rural non-point source pollution. It not only describes the characteristics of rural non-point source pollution, but also illustrates the analysis and sum up of types and damages of rural non-point source pollution in China.Chapter three illustrates the reasons of rural non-point source pollution in China from legal perspective. This paper proposes some coping tactics to conquer existed problems in rural non-point source pollution legal mechanism.Chapter four introduces effective experiences of Japan, USA, European Union and the other developed countries. It mainly illustrates beneficial enlightenment to China’s legal practices and procedures.Chapter five proposes legal suggestions and preliminary ideas about how to prevent and control rural non-point source pollution in China on the base of researches that have mentioned in the former chapters.
