Law Research On The Ecological Environment Environment Compensation Legal System During The Development Of Mineral Resource

Mineral resources has laid an important material foundation in the process ofdevelopment of human society. After the industrial revolution, the rapid development ofthe industrial world has not only greatly enhanced the level of human life, but alsocaused serious damage of ecological environment. Since the1950’s, in order to solve theresource depletion and ecological environment problems, international experts did theirresearch on ecological compensation from different fields of study. Nowadays, we applythe ecological compensation all along the exploitation of mineral resources to solve theenvironment damage problem, which constitute the ecological compensation system.This paper is divided into five parts to study the development of mineral resourcesecological compensation legal system environment. The first part introduces the basictheory of ecological environment in the exploitation of mineral resources compensationsystem, focuses on the connotation of ecological compensation system for mineralresources development, and exhaustible resources theory, public goods theory,ecological capital theory, the theory of sustainable development. The second partintroduces the legal status of ecological environment in the exploitation of mineralresources compensation system, summarizes the mineral development of ecologicalenvironment in our country compensation pilot experience, find out the existing mineralresources development of China’s ecological environment compensation problems inpilot. The third part focuses on the foreign experience and the Enlightenment of thelegal system of compensation of ecological environment in the exploitation of mineralresources. There are fifth parts in the ecological environment in the exploitation ofmineral resources compensation problems in the legal system, proposes the strategy ofecological environment compensation of mineral resources legal system perfect.Through the research on the compensation system of mineral resources developmentand ecological environment in China, to provide reference for the development of thecompensation system of mineral resources development and ecological environment in china.
