Research On The Legal System Of Ecological Compensation Under The Ecology View Of Marxism

Since the reform and open policy,our country economy has made remarkable achievements,but at the same time a series of ecological problems of economic development followed.Western air pollution,water pollution,desertification,soil erosion environment problems happened frequently,this not only caused serious losses to the national economy,also had a lot of negative effects on social stability.In fact,the ecological crisis has restricted the development of the national economy in China,this is the basic national conditions in our country have to face.In this context,the third plenary session of the 18 proposed to the comprehensive construction of ecological civilization,establish a complete ecological system civilization system,protect the ecological environment with the system.Clear the position and role of the ecological environment in the human social development,change the traditional concept of "priceless" environmental resources,through the optimization of ecological environment and resources allocation,guides the people under the premise of respect for nature,reasonable development,utilization and protection of ecological environment,promote the harmonious development of economy and environment in our country.Ecological compensation system for ecological environment protection is of great significance,it was based on the ecological view of Marxism as a guide,in order to benefit and order as the logical starting point,the pursuit of justice and the value goal of sustainable development,use economic means to adjust the relations between rights and obligations of related interest subjects.In the central and local legislation in our country has made relevant provision,the ecological compensation system on practice,the government through fiscal subsidies,set up the ecological compensation fund,and in the form of taxes and the project practice,but there are still many problems,can not meet the urgent need on the implementation of sustainable development strategy.Ecological compensation system lack of a perfect legislation system,compensation subject are not clear,compensation standard is unreasonable,compensation funds are of inadequate and low degree of market function,all the things have seriously effect on the normal play of ecological compensation system.Aiming at the shortcomings of the ecological compensation legislation and practice in our country,learn from foreign ecological compensation practices and policies of beneficial experience,under the guidance of Marxism ecological view,and put forward some Suggestions of perfecting our country's legal system of ecological compensation,formulate unified the ecological compensation law,perfect the ecological compensation laws and regulations to build a perfect ecological compensation legal system;Clear the government,social organizations and the beneficiary is the compensation ecological compensation subject;To reflect social fairness and justice,compensation will conform to the social and economic development level of compensation standard;Through perfecting of property rights of the ecological environment factors,and promote the government and market integration,be better to play the role of the market economy in ecological compensation;To perfect our fiscal transfer payment system and environmental protection in the field of investment and financing system,and safeguard the ecological compensation funds sufficient.
