Regional Environmental Legal System In The Western National Study

Environment protection, including the environment protection of western minority areas, is one of the most critical major issues in China asking for necessary attention and tremendous endeavor. The unique ecological environment and special geographic location of western minority areas have attached important significance to the environment protection of China's minority areas. Thus, it is the initial purpose of this paper to discuss a solution of western minority areas' environment protection through a legislative approach. However, most of the existing researches concerning this issue have just been restricted or limited to a discussion of "Environment Law", neither has any author done a comprehensively in-depth analysis of environment protection from the economic angle, nor did they provide any environmentally sustainable solutions. This paper attempts to make up for this deficiency by starting with an analysis of local governments' industry polices. The author will then exam the relationship between industries polices and environment protection and try to suggests a solution of minority area's environment protection.Just as all the legal issues, the issue of environment protection also has deep economic reasons. Based on the existing research achievements, this paper will adopt economic analysis method, systems analysis method and empirical analysis method to carry out an in-depth discussion concerning the emerging, development and economic reasons of western minority area's environment protection problem while addressing the specific local situation of these areas. After the analysis of the economic reason of the western minority areas' environment protection, this paper exams the current legislative situation and then suggests the ideas and accordingly specific systematic design for the promotion of legislation of environment law in minority areas. This paper has been divided into three chapters plus a preface and a conclusion. The first chapter presents "A summary of minority areas' environment protection". The concept of minority areas' environment protection is introduced in this chapter, and then the author analyzes the basic characteristics of minority areas' biological environment and social development. The purpose of this chapter is to provide basic materials for the discussion of western minority areas' environment protection. After this chapter's research, three characters of western minority areas are identified: A. Abundance in natural resources; B. Comparatively immature social development; C. The frangibility of ecological environment. And the following discussion of this chapter reveals of political and sustainable development significance of environment protection as well as providing a macro context introduction of western minority areas' environment protection. The second chapter presents a analysis of western minority areas' main industries. Adopting an economic approach, This chapter analyzes impacts of various industries to the local government revenue and then reaches a conclusion that the minority areas' governments tend to develop the local heavy chemical industries; Based on this conclusion, the author expresses the theory that the over developments of heavy chemical industries is the major factor which caused the environment problem of minority areas and reveals the disadvantages of the current legal system The third chapter conducts analysis from an environment law approach, and makes several suggestions concerning the promotion of environment law.
