Research On The Penalty System Of Juvenile Crime

With the development of economy and society, juvenile crime has become a prominent issue to the international community and rises attention and concern in criminal theories and judicial practice of every country. Through long-term exploration of theory and unremitting social practice,every country has formed their own distinctive judicial philosophy and established its penal system under the guidance of the philosophy. Against juvenile offenders, although China has established the principle "focus on education, supplemented by punishment" and made provision in the Criminal Code accordingly, there are still some inadequacy of planning in specific system needed to be improved by appropriate measures. Specifically,it includes the amendment of the applicable penalty types of juvenile offenders, the improvement of adjudication system of punishment against juvenile offenders, the soundness of implementation systems of penalty and establishment of non-penalty punishment system. The article tried to build a complete penalty system of juvenile crime close to the judicial practice in our criminal code, in order to achieve the purpose of protection of the society and juveniles, and also demonstrate the value of justice and tolerance.
