Research On Claim Analysis Of Construction Project

Claim is a reasonable re-distribution of responsibility, power and interest, and is also the re-assessment of the risk ratio between the contractor and the owner. It is an important measure for contractors to safeguard their legitimate rights and interests in international construction market. However market degree is insufficient now, the administration of claim is still a weak part in construction management of our country, so the research on construction claim is very necessary.From the view of contractor, this paper researches comprehensively construction claim. First, based on the analysis of the definition and characteristics of the construction claim, the paper discusses the procedures and classification of construction claim, the basic requirements, contents, and claim evidence. Then, on the basis of decision procedure of construction claim, analyses the concept and formation of contract status, establishes mathematical model for claim opportunity analysis, to discovery formation mechanism of potential claim opportunity through the research contract state of time-varying system. To recognize claim opportunity, this paper proposes four methods in contract, cost, process, and activity. Third, after recognizing claim opportunity and deciding claim, the paper discusses the calculation of claim for time delay. For time claim, around the claim caused by multi-event cross interference, this paper presents an ameliorative algorithm for Shapely Value method. In this algorithm, time delay responsibility is allotted to each single responsible activity by Shapley Value, and then allotted between the owner and the contractor in each single responsible activity by means of fuzzy comprehensive evaluation method. Then combined with engineering example, how use Shapley value to calculate time claim is studies. In cost claim, paper details the composition and calculation method of cost claim around labor cost, material cost, mechanical cost, etc, studies two kinds of methods, namely the total cost method and partial method, and discusses the advantages-disadvantages and working conditions of these two methods. Finally from legal equality relations and logical relationship, paper discusses the concept of counterclaim, and then points out its bidirectional characterization. According function and implementation of content of counterclaim management for contractor, measures are put forward to enhance contractors'level of management.On the basis of combination of claim theory and available methods, this paper applies mathematical technique to solve some key problems of construction claim. This research emphasizes the maneuverability and practicability of theory, provides some feasible methods and advises for contractor to resolve claim dispute, in the hope of directing supervisor of construction project in our country and heightening mission success rate of construction claim.
