Study On Contractors’ Claim Management In Construction Project

In recent years, with the continuous scale expansion of international construction projects, China has been widely participating in international projects. The increasingly complicated and difficult engineering technologies highly increase the complexity of contractors’ claim management, thus it is of great importance to research its functions and significances. Since the 2013 Code of Valuation with Bill Quantity of Construction Works came into effect, the terms and conditions of content of detailed, expansion and specifications, contractors’claim management has encountered with unprecedented challenges and opportunities. Although China has been delved into claim cases for years, the successful cases are just the tip of the iceberg compared with the huge number of projects. What is worse, the contractors have become passive in the claim management,some are not ready to claim before the work actively, the other are after the claim application is no longer concern the progress of follow-up,and not only lose a lot of potential opportunities for claims,but also make originally can successfully claim due to contractor’s slack becomes difficult and passive. At last, numerous emerging problems concerning claim indicate,and has brought many problems to the contractor’s construction process and settlement, serious impact on the efficiency of project construction, brings to the enterprise development, so that it is necessary to explore current contractors’ claim management.Firstly, analysis was made on domestic and foreign researches concerning claims and code of valuation with bill quantity of construction works to summarize the development course of China valuation with bill quantity with a focus on the characteristics and innovation of the 2013 edition. Secondly, related theories of claims and the knowledge of contractors’ claim management was reviewed to discuss the similarities and differences of the specifications concerning claims between quota mode and list mode and between the 2008 and 2013 editions of the code of valuation with bill quantity of construction works. Then the claim opportunities and unbalanced bidding opportunities in 2013 Code of Valuation with Bill Quantity of Construction Works and the model text of the construction contract were concluded to detail the claim preparation and management of the new code at all construction stages. Finally, based on the introduction of game theory and Bayesian theory, qualitative analysis was made on claim decision-making and negotiation to obtain specific steps and methods, and quantitative analysis based on the integration of mathematical method and case study was made on contractors’ bargaining game model corrected by Bayesian theory.The achievements of this paper are that it included the comprehensive summary of the opportunities, unbalanced bidding opportunities and related basis in 2013 Code of Valuation with Bill Quantity of Construction Works, proposed the strategies for contractors’ claim management at each stage of the construction process of the project, and combined the 2013 code and Bayesian theory to make qualitative analysis on claim decision-making and negotiation and quantitative analysis on the bargaining game model between both sides of the contract.Finally, in view of the actual case can know, this paper sums up the various claims of the opportunity and in different stages of the project construction contractor claim strategy does provide the contractor claims put forward to provide help, and as a basis and evidence for reasonable time limit for a project and cost claim; And claim for compensation after combining with the corresponding mathematic model algorithm can rational utilization in the engineering example, provide data support to solve the problem of the engineering practice, and have obtained the satisfactory effect.
