International Construction Project Claim Opportunity Identification Research Based On Process Controlling Under Fidic Contract Condition

Due to the characteristics of complex, long-term, dynamic circumstance of international project, there are many interferential factors and unpredictable risks when carrying out a project, which leads to lots of claims to companies. Those inevitable problems directly influence contractors' profits and supervisory abilities. Therefore, it is very important to identify accurately opportunity of claims to contractors in time, which could help them to grasp_the opportunity of claims and then figure out how to resolve these problems.This research is based on FIDIC Construction Contract Conditions of 1999;author analyzes the clauses in the FIDIC contract that relates to claims, which especially emphases on some clauses that contractors could claim for compensation. By analyzing these clauses, the author puts forward the key point of every clause to make the contractors know how to manage claims.Furthermore, the author points out the opportunity of potential counterclaim when the whole project is carried out by identifying and analyzing the risks of claims during the early stage of biding for a project and signing a contract, in order to provide useful resources and references to contractors to complete the task of recognizing the claims in the future. Besides, by utilizing analysis of contract, event, process and cost to discern and analyze the construction, completion and claims opportunity of project and establishing a set of recognition process controlling model of contractor's claims opportunity under the guidance of controlling process ideology, the management level of contractor's claims and the efficiency of processing claims would be improved and contractor's optimal claims opportunity would not be avoided.Nowadays, because the competition in the international project market is very fierce, contractors could adopt claim opportunity identification process controlling model to identify and analyze accurately the opportunity of claims when carrying out a project in time to improve the efficiency of managing claims and to avoid_missing the best time to claim for compensation.
