Transportation is the basic, guiding and overall industry in national economy, which plays a very important role in ensuring sustained, healthy and rapid development of national economy, improving people's lives and promotes the modernization of national defense etc. In particular, the highway is an important part of modern transportation, its modernization and development level has become one important indicator which measures the level of a country's economy and modernization. Since Reform and Opening, China's road construction has made substantial progress, but compared to China's social economic development, it is still lagging behind, especially in highway construction, compared with developed countries, the gap is large. According to the"Fifth","Eleventh"Five-Year Plan and the forecast from actual construction experience, by 2020, the China Road will be in the rapid development stage, will come to be the world's largest highway network construction, especially in the high-speed highway construction which is the main backbone of road network. To speed up the construction of highway network, many difficulties will be faced by, the most prominent and critical issue is the serious shortage of building funds. Every year the building fund for construction of highway is about 200 billion or so. To alleviate the problem of the insufficient funds for construction, we must take the way of international, marketization and socialization financing, based on policy-based financing and supplemented with BOT and other financing ways.The distinguishing feature of BOT model is the separation of its ownership and management, generally it applies only to those public programs which have low competition, have certain monopoly, with huge investment and long payback time, in other words, they are facility and service programs which gain incomes through charging for their users. The experience of financing by BOT model all over the world shows that, BOT is a effective way to solve the shortage of funding for infrastructure construction. Highway is the inevitable product with the development of commodity economy, which itself has a strong product attributes, the use of BOT financing model is a good form, good way to assist resolving the lack of funds for highway construction , the evolution of several forms of BOT model has been used in China. compared with the general ways of international practice and Hong Kong's main practice, there are still prominent problems on the application of BOT model in Shantou-Jieyang Highway, for example, in the foundation work, the congruent of the legal system and other aspects . Drawing on experience of the highway building with BOT model, we should make specific BOT legislation, should strengthen the regulation of basic work of BOT projects, should establish an effective monitoring system for highway BOT projects , should provide good basic training of BOT model, so there will be breakthrough on projects which use BOT financing model.
