China's Circular Economy Legislation Research

Circulatory economy is a new formation of economy comparing to that of the traditional one.It advocates a mode that develops economy in harmony with the environment.In order to reduce the use of resources,to repeat the use of products,and to make good use of vast as a resource.It is a process of enclosed feedback circulation of enclosed feedback circulation of resource- product-regenerated resource.The sustainable development stragety has been advocated since the last decade of last century.The developed countries are now regarding developing circulatory economy and building circulatony society as an important way to put sustainable development stragety into practice.Our country also pays special attention to the development of circulatory economy.It has been mentioned in the eleventh "Five-year Plan" that it is an important way to construct a society which economizes resources and is in a friendly environment to realize sustainable development.It is necessary to guard the development of circulatory economy by laws.Afer years of practice,some developed countries has legalized the circulatory economy. However,in our country the legislation for circulatory economy has just started.The effect of circulatory economy has just been partly mentioned in few law rules,and the mention is not comprehensive and systematic.Therefore,it is imperatively necessary for our country to legislate for circulatory economy in order to gurantee the development of it.The present paper aims to put forward the consideration of legislation for it from the basic theory of circulatory economy,the practical experience in other countries and the present situation of legislation for circulatory economy and its shortcomings in our country.It argues that it is necessary for our country to make and amend the related laws and rules in practice to form the law system of circulatory economy while speeding up making the general law for it.By doing this,it is hopeful to push forward the development of circulatory economy so as to strengthen the capacity of sustainable development and to build a economizing society in our country.
