| The development of modern industrial civilization has created the prosperous material civilization for human beings, but it also created the giant matters to affect the exist and development of people. Circular economy is a new developmental ideal, and is an important change of traditional economic development and the model of utilizing resources and the model of protecting environment. Developmenting circular economy is an important approach of realizing economic sustainable development, setting up society in which save resource and has friendship with environment. The health and order of circular economy development needs intact laws and systems as guarantee, but our present law exists many disadvantages, so perfecting circular economy law becomes our important task. So, this text carries on special research to the legal system of circular economy, not only the need of constituting the circular economy law and policy, but also the need of carrying out scientific outlook, promoting sustainable development, realizing the common survival of man and nature, which has an important theorial value and realism meaning.Besides preface and conclusion, this paper is divided into 3 parts:Part one, introducing the relevant basic contents of circular economy and giving the definition of the legal system of the circular economy, propose that circular economy law should become an absolute law section, finally analyze the necessity of the circular economy law.Part two, choose more representative country in circular economy legislation: U.S.A., Germany, Japan, the European Union carry on comparative analysis and summarize the common point from legislative idea, legislative mode, system and law system innovation, etc. offer the reference for the legal foundation and completion of our circular economy.Part three, introducing the practice of our circular economy, analyzing the question which our circular economy law existed, propose the idealm, principle and basic thinking of circular economy law, finally conceive the basic content of the circular economy law of People' s Republic of China. |
