China's owner committee as a newly developed committee self-rule organization emerges along with the changing of new owner form (ownership of the premises). After the founding of The People's Republic of China, urban housing adopts a system that one's work unit directly distributes houses to the worker. The house property belongs to the unit. With the establishment of market economy, in 1990s urban housing distribution system began to reform. The new housing system will be real time, the private house ownership emerges. The building management runs by work unit's department responsible for maintenance, service and management, changes to running by the owner himself. The housing management begins marketization. The owner licensed the property to professional property company, and supervise it through the owner committee. The owner committee as an organization directly related to the owner's property and housing management, and is closely related to all the members of the society's life order.The owner committee as owner corporation's important part, is very consequential in property administration.The found of owner committee system urges property administration more and more normative. The establishement of the owner committee is able to cooperate with the government to improve property administrative supervision, and is also the trend of establishing efficient modern government. It can promote the market competition mechanism, and realize the owner and property management company autonomy restricted. However, the lacuna of owner committee system itself blocks the development of property administration to a certain extent. For example, the wner committee's legal status is not clear and lack of owner committee supervision mechanism, the establishing of the owner committee is difficult, and the deficiencies. Recently, as the growing of the owner rights movement, property management dispute ascends. The types of cases are various. The complex legal relation, strong social sensitivity, sharpened conflict, lack of experience in law, no consistent applicable law cause the attention from all walks of life. Between owners, owners and property company, owners and developers's contradiction, varies social relationship is still changing. The duration of dynamic process is not only a law problem, but also a strong practical social problem.From the owners' committee characteristics and content, in the thesis the author will discuss the influence of owner committee to the property management, Analyze China's property management in operation of the owners' committee present situation, the existence question and the reason. The author corresponds measures and suggestions for improvement from the legislation and improve the operation, establishing the owners' committee overseeing mechanism, to realizing the owners' committee functions, to strengthen the government's role in establishing owner committee system. It profound significance to improve property management and to maintain social stability.In the thesis the author will discuss how to consummate the owner committee system, and advance the property administration. The thesis constitutes three parts. The first part expatiates on the basic meaning of the owner committee. The second part researches the promotion of the development of owner committee system to property administration. The third part discusses the problem of owner committee system and the conceive of consummating the system.
