This thesis points out that the paternalism -, the theory of autonomous right and the model of mercy all fail to reveal the new traits and it's denotation of the patient-physician relationship. This has been proved by the patient's right dilemmas, which is commonly exists, theoretically and practically. Therefore, this thesis, based on an analysis of the change in modern patient-physician relationship, aims to supply an apt model of the patient-physician relationship and use it to detect and dispel the patient's right dilemmas.The outcome after research is that: patient's right entrustment is the realization in the patient-physician relationship of the faith entrustment, which exists in large amount in the human exchange activities, and the foundation of links between patients and physicians. These like are therefore characterized by contracts, which, however take to form of documents, but that of the convention. This shapes a general contract model, according to which the patients belong to weak group; though they have obligations, their rights need more preservation. Laws are not always in favor of patient's right, while this loss can be compensated by the common sympathy for the weak, so to put patients in a favorable position.The core of the patient's right dilemmas is the contradiction between the health right and the autonomous rights. According to the given model here, patients' rights can be separated from them; after the acceptance of the right shift, the physicians are to deal with the contradiction in light of the medical science. Definitely, the way the physicians choose can be accepted by the majesty of the cultural community to which the patients belong, hi this way can the confusion be dispelled.In addition, this thesis analyses two cases, by employing this model; thus, to highlight the importance of the non-medical responsibility of the hospital to the patients and the fostering of trust between them.
