Confucian Legal thought after confucius had split up into two branches, which respectively take men cius and Xunzi as representatives, Mencius Laid particular emphasis on interiting and developing Confucian study of benevolence, and practising the policy of benevolence, while Xunzi concentrated on developing Confucius' etiquette terms, and proposing the policy of etiquette ruling. This paper expects to compare the legal thought of Mencius and that of Xunzi in these aspects: the human nature is wickedness, the origin of law, the fundamental Value of law, enforcements of law , and prerentive measures against crimes.Xunzi also produces a systematic theory of converting man's evil and veiling falseness. On the basis of human nature reformation theory, he brought, forth his ruling theory-worshipping ceremony and advocating law. Xunzi's courtesy theories get rid of idealist color of Confucianism fully, having the careful, stern characteristics, providing the foundation of the consciousness for the rise of the future generation authority doctrine, attaching importance to courtesy and emphasizing legal system. Linking courtesy with law can be found throughout all his political thoughts. The "unman ruling" theory of Confucianism has reflected the monarchic Xunzi supported the monarchic power. The monarchic power thoughts of Xunzi are the embryo of Chinese feudalist law theory.The fundamental trait of Xunzi's morals-and-law is that both morals and law were emphasized. During the period of construction of socialism modernization this ideas have great significance to solve the various social problems especially to the relation between morals and law. As while, at the end of the warring states period, Xinzi inherited the ideas of the eminent scholars in pre-Qing Daansty, formulating his unique and systematic Views on social seniority, the philosophical numeral basis of naturalness as law of universe, the political forms of valuing ethics and law, and the eccentric ideologies of making his country prosperous and its people rich, such views have exerted an extensive and far-reaching impact on China's society ever since then.
