Xunzi Rites And Emphasizing Law "system Of Thinking Ethical Implications

Living in the eve period when Spring and Autumn Period and Warring States had been turning the split status into unification, Xunzi's political system design of"emphasis on Li and Fa"provided an important theoretical foundation for the unification of States. Born with the full-bodied Confucius ethics characteristics, his design contained abundant institutional ethnical implication. This dissertation will dig out its implication from the following perspectives.First of all, concept of human nature is the theoretical foundation of Xunzi's idea of"emphasis on Li and Fa". Xunzi advocates the evil side of human nature. While Confucius concept of human nature essentially contains blur ethnic judgment of the mixture of goodness and evil and Mencius concept of goodness of human nature is the discovery and amplification of the goodness elements of Confucius concept of human nature, from which inside humanism of De concept came into being. Xunzi's judgment on the evil of human nature traces back to the latent evil nature factor in Confucius judgments on human nature and made deeper and thorough analysis, so his judgments on human nature are much more transparent and profound than Confucius. Xunzi's understanding of evil humanism further deepened the sociological concept of"Ming Fen Shi un", whose main standard and gist is Li deriving from the social confinement over evil side of human nature. Besides, evil human nature also is the theoretical basis for Xunzi's melting Fa into Li and achievement of the establishment of political system"emphasis on Li and Fa".Secondly, as the main idea of Xunzi's construction of political system, Li's theoretical value orientation is placing the will of human first and emphasizing Li's principal role in constructing harmony society. And its ultimate purport of Xunzi's concept of Fa is to root out crucifixion by crucifixion and achieve virtues by Fa and accomplish final harmony society. Ethnical tone implied in the political system of Li and Fa decides rationality and justice of the political system itself. While Yi is the core concept of the implication of system of"emphasis on Li and Fa", in which embodies the spirit of mean and humanism and features the combination of wisdom and virtue, abstract and concreteness, theory and practice. On the contrary, the implication and characteristics of Yi decides the main content of Xunzi's concept of"emphasis on Li and Fa", which include respects for emperors, putting people first, government by man and fair regulations. On the other hand, the pursuit of fair regulations also contains institutional philology of advancing with the times of Xunzi's concept of"emphasis on Li and Fa"and self-adjusted mechanism.Thirdly, any doctrine and thought surviving several thousand years and still keeping influence must have universal reasonable factors matching every particular epoch. Xunzi's concept of"emphasis on Li and Fa"implies beneficial traditional ethnic cultural and institutional resources which help provide the construction, stability and maintenance of modern social harmony for current China. The elimination or desalt of negative factors like centralization and stern hierarchy in Xunzi's concept contains reasonable ethnic thoughts of equal emphasis on De and Fa and the pursuit of double-win of collective interests and individual interests, which have significant reference and enlightenment for establishment of"economic person"and"ethnic person"-dominated market economy, enhancement and perfection of market economy system, construction of political civilization and institutional reform and innovation.
