Residential Parking Spaces Ownership Issues Research

It is not new that the disputes caused by the problem of community parking space ownership in China. In recent years, with the improvement of people's living standard brought about by the private auto possession of a great growth, such dispute has intensified trend. The promulgated of "Property law" is expected as a hopefully legislation to solve the dispute over ownership, however, it is the fact that when the originally disputed object was clear by the legislation, other problems caused by the not perfect and excessive principle of the law. Judicial interpretations were enacted by the supreme people's court to solve the problem, but through the research and analysis to the judicial interpretation, we can easily find that there still exists plenty of problems in the current regulation.This paper tries to summarize the theories and opinions of the community parking space ownership in our academic circles and comparison the relevant system of developed countries, to find the deficiencies of current regulations and put forward the suggestions. This paper puts forward Suggestions related regulations of our country, and I hope to offer some guidance real right legislation.
