Study Of China's Government Procurement Supervisory And Legal System

Since 1995,China's government procurement has been carried out for more than ten years. It has made great achievements in saving public finance and resources. But as the scale constantly expanding, the government procurement activity appears many undesirable phenomenons, which has seriously affected the government procurement working smoothly. The reason why those phenomenons occurred is that our country didn't establish comprehensive government procurement supervising system, so it cannot monitor sustained and effected. In order to ensure the government procurement working healthy, we should improve the regulatory legal system of government procurement supervision in our country as soon as possible.Thesis focuses on the improvement of legal system of the government procurement supervision. It based the study of theory of government procurement supervision, then finds out the problems and roots the causes of these problems. It also analyzes the legal system of government procurement supervision in the world, summarize their features and experience.Finally, the author put forward the suggestion of perfecting the legal system of government procurement supervision in our country. This paper firstly describes the implications of government procurement supervision, theoretical basis and functions. Second, the author investigate the reality of China's government procurement supervision legal system, and the supervise subject, object, principles and any other contents related to government procurement supervision, and then analyzes the problems of them, including:legal definition has not define clearly; the confliction of the law; absence of the supervise subject; the lack of the supervision from the vender; the range of supervision is too narrow and so on. Third, the author summarizes the features of international government procurement supervision system and there are four enlightenments for our country:improving the government procurement supervision legal system; establishing the supervise object system that are mutually checked; paying attention to the audit of government procurement and the protection of venders. In the end, basing the preceding analysis of the issues,the author advise that we should improve the government procurement supervision legal system from the following points:declare the legal definition; establishing an unified legal system; improving the eternal and external supervision; strengthening the supervision of private right from venders; expanding the scope of supervision and many other aspects.
