The complaining system in our country has the features as an administrative relief system when it was set up in the early days.When the central government and local government handling of complaint cases between the authority and right, the problem exits is an unreasonable division of the rights and ambiguous powers .The structure of letters reporting system and accepting authority are complex, the right crosses the scope and there is a serious lack of petition procedures.Petition sector is bureaucratic, and there is a serious lack of practical in the staff's attitudes towards work and the quality of work. Civil petition organizations have seriously disturbed the formal petition sector when solve the problem. "Petition" covers too broad, easy to make people have errors. Petition event handling method is too simple and easy to bring harm to the grass-roots cadres. Petitioner's appeal can not, to resolve grievances can not be effectively divert. Petition system is"left", not according to specifications. Letters to the criminal justice system has caused a great impact. This paper discusses the four parts:Part I: Status and Problems of the petition system. In this section, I will be fully expounded China's petition system and the status of the development process, discusses the existence of dozens of petition system problems.Part II: The law of criminal justice and defect.
