The Research Of Management Realate To Petition Letter About The Court System In Fuzhou

The reform of the petition work is an important field in comprehensively promoting the rule of law. The court petition work play an more and more important and difficult part in coordinating the conflicts of interest and resolving the hidden social contradiction of the case. However, the cases of the complainants "believe the letters and calls but not believe the law" still exist, as well as the element that affects the legalization of petion. The legalization level of letters and visits relating to civil lawsuit is still to be improved,so we need urgently to settle the problems regarding to the petitions.As the capital of Fujian, Fuzhou is one of cities abaut the national strategy of West Coast, the letters and visits relating to civil lawsuit problems in Fuzhou are representative in national ones, the court petition problem of Fuzhou representative in the court petition work. Thereby, it has tremely important significance to research the Fuzhou’s court petition problem to promote the development of Fuzhou court science and settle the case contradiction preferably.In this paper, I set about the study from actual petition letters of court system in Fuzhou. First of all, I make a comprehensive analysis and inductions for the existing documents, explain research progress at home and abroad and some similar concepts related about the petition system and introduce famous the Social relief valve and the Game theory. Secondly,this paper collect petitinners and obtain the real data from court to sum up and analyze system development process,results,existing problems about Fuzhou’s court complaint reporting petition letter with the methods of questionnaire survey, data analysis, empirical analysis. The existing problems are lacking of legal rules,the single interactive means,the legal quality of the local is not high, etc. Then, take two typical cases happenning in the court of fuzhou to get some experience in solutiing petition cases. Finally, according to the survey results, combined with the actual situation of of Fuzhou court’s petition letter in practice,I conclude the characteristics economic and social development of Fuzhou and use for reference good experience at home and abroad to make proposals and suggestion from five aspects, they are promoting publicity and education of law and rules on petition letter,establishing and impoving the online petition system, improving the construction of the court itself, strengthing the legal knowledge about petition letter,establishing and perfectting the online reporting system.
