Legislation Of China On Foreign Repatriation System

As the development of the globalization of world economy, the movement of people from one country to another becomes more and more frequent. In recent years, with the development of China open and reform policy, the number of foreigners who came to China increased year by year. It brings our economy development, at the same time, it challenges our administration of immigrations.Among the foreigners came to China, parts of them are illegal migrants, and a number of them commit crimes or violated Chinese laws and regulations. According to the international practice and rules, almost all the countries set the laws to deport them.However, China hasn't set the deportation law, compared with the developed countries, our regulations are simple and lack of international law supports. For example, deportation casually, deport without appeal etc. So I try to analyze such questions in this article to talk about how to build our law system, how to protect the human rights.Firstly, the author used the concept of deport system and the basic of international law, and then, talked about the principal of deportation, after that, through analyzing some international deportation cases, show us how these principals were used during the case investigation. By these, we can find how many questions and confusions are exist in our nowadays deport system. Finally, the author points out what kind of spirit and principals we should obey, and how to build our law system. Especially, the author gives us the view of setting an institution for aliens'deportation and rescue.The author focus on the questions of the deport system, and the principals of ICCPR. The author also tells us the importance of balancing the national security and protection of human rights, the necessity of how to make the deport system maturity.
