The EU constitution has passed through a tortuous process in the first decade of this century to a compromise of the Lisbon Treaty from the Laeken Declaration which marks the start of the assembly process. The significance of the EU constitution is to provide a complete system of norms and regulations to confirm the legitimacy of EU governance and to maintain the values of European identity. The cultivation of this identity is far from the progress of the system design by the lack of publicsphere construction and political participation and the bureaucratism of the elite. It's hard to create the new tacit understanding based on the European identity and the old tacit understanding of the early days is disappearing between elite and people. The treaty ratification process is precisely the negation of the elite-driven model although the the goal achieved initial through the withdrawal of the veto. It's helpful to make a deep understanding of the EU constitution in the initial results and challenges by investigating the role of the elite in the constitutional process based on the relations between the elite and the public.Paper is divided into four parts, the first chapter introduces the topics of reason, research status, the papers research methods. The second chapter outlines the background and process of the EU Constitution, explained the the function and role of the elite. The third chapter presented the perspective of the constitutional process study and compared the the differences in benefit and identity between the elite and the public. Then discussed the bureaucracy tendency which gradually emerging out in the publicsphere and give detailed analysis of the two constitutional crises and pointed out that there is a dislocation between the Europe of elite and Europe of citizen. The fourth chapter summarized the positive significance and limitations of the Lisbon Treaty in system construction, expanding democracy and improving the decision-making procedures and thought about the changing role of the elite in the future. Proposed that the elite should be more transparent, open and efficient in the career to the future European constitution and displays the system advantage in democratic consultation of European parliament and enhances public participation degree for the true sense of the Europe of citizen.
