In recent years, with the establishment and development of the market economy system, China's labor relations have undergone profound changes, and the labor relations in the enterprises are becoming increasingly diverse and complex, the number of labor dispute cases have also increased significantly, the quantity of labor dispute cases throughout various regions shows the "blowout" situation. But with the successive introduction of various laws such as "Labor Contract Law", "Employment Promotion Law" and "Labor Dispute Mediation and Arbitration Law", China's labor law research also shows the trend of transferring from the cold to the heat. Facing the increasing labor dispute cases, re-examination and reform of China's labor dispute disposal system has become a common focus of attention in the Theory Circle and the Practice Circle. This paper mainly focuses on the existing difficulties in China's labor dispute disposal system, analyzes and discusses the existing problems, and proposes some suggestions and ideas on the legislative and institutional innovation. The paper has five chapters:Chapter One mainly gives a simple introduction on the historical development of China's labor dispute disposal system.Chapter Two discusses the theoretical basis of China's labor dispute disposal system, and it mainly analyzes various existing contradictory relationship and basic principles of China's labor dispute disposal system.Chapter Three makes a comparison between the developed countries and regions of China's labor dispute disposal system and analyzes its reference significance.Chapter Four elaborates the present situations and the existing difficulties of China's labor dispute disposal system.Chapter Five mainly puts forward some suggestions and ideas to perfect China's labor dispute disposal system, expects to arise full attention of the relevant legislative institutions, puts the reconstruction of China's labor dispute disposal system on the agenda as soon as possible, and constructs more harmonious labor relations at an early date, thus promotes the smooth and healthy development of socialist modernization suggestions.
