Investigation And Interrogation System

Interrogation of the criminal suspect in the investigation stage of criminal procedure is a very important investigation method and means to gain evidence and clues, which plays a vital role in disclosing and proving the crimes. The interrogation may determine whether the criminal process in a case can continue and even may influence the last result, so it arouses the attention of many countries. In modern society, confessions are still key basis and breaking point for judiciary staff to solve the cases. In China, the investigation technology is still not so advanced, so it is common that the investigation staff depend on confessions. Besides, there also exist many demerits and flaws in investigation and interrogation system.In the background of our country's second-round judiciary reform advancement, the study on investigation and interrogation system must base itself on China society's practical situation. Then the study aims at coordinating the dialectical relations between maintaining society's stability and respecting and protecting human rights, and dealing with the conflicts and contradiction properly between the result value, the procedure value and the efficiency value in investigation and interrogation system of the criminal procedure. Meanwhile, the study must learn helpful foreign experiences. Three aspects will be considered to perfect investigation and interrogation system:1). initiating condition for investigation and interrogation.2), regulations on investigation and interrogation, including subject, method, time and place.3), supervision of the process of investigation and interrogation. By setting up scientific investigation and interrogation system, strengthening supervision and restricts on interrogation rights, and protecting criminal suspects'rights from being violated, it is aimed to realize the dual tasks:punishing the criminals by criminal procedures and protecting human rights. For the above aim, this thesis attempts to make some studies on how to construct our country's criminal investigation and interrogation system.
