Oil spilling in Gulf of Mexico, Japanese nuclear accident arising from the earthquake and tsunami, severe situation of sand storm in north China......the environmental polution arising from industrialized production is increasingly serious, and the human being civilization is encroached up day by day, the consequece results from the environmental problem has had a negtive influence on the the entire economic system or even on the normal running of the whole society directly or indirectly. Under this background, we people have been graduly aware of the hazard brought by blindly pursuing of enconomic increasing, and been seeking for a new system to guide the action of enterprises, and thus, the Green credit emerge as the times require.The Equator Principles are criteria of financial industry, which is built up by the essential financial institutions in the world according to the policies and guidelines of International Finance Corporation and the World Bank and are aim to judge, evaluate and manage the environmental and social risk in project financing. The Principles have had been accepted by most of the banks in the world. Ministry of Environmental Protection,People's Bank and The China Banking Regulatory Commission jointly promulgated a new policy"Green Credit"in July,2007 in order to limit the growth of high energy-consumption and high pollution enterprises. However, there are quatities of problems existing in the operation of Green credit, such as shortage in sharing and publishing of environmental information, absence of uniform practice standard in law and so on which greatly affects the role Green credit played in the protection of the environment. Now that only policy controlling is far from sufficent due to the unstableness of policy, then it is particularly urgent to establish Green credit law system and regulate the action of enterprises and finacial institution.The paper will discuss and study some issues on the Green credit in five parts:The first part:the overview of Green credit, and brief the concept of credit, environmental risk in credit, and introduce the history and basement of Green credit;The second part:the value analysis and necessity analysis of Green credit;The third part:the analysis and summary of outstanding practical experience of Green credit law system in some developed countries; The fourth part:the research of Green credit in China in the view of legal practice, banking practice and international co-operation, and point out the legal straits we are facing presently;The fifth part:the suggestion on constructing and perfecting the Green credit legal system in China on the basis of internal and external experiences of pratice and legislation, as well as Chinese practical situation.
