With the promotion of the legalization, our notary offices have changed to public institutions from government agencies and will become the agency organization like a bridge between the state and the citizens further. And the notaries have become professionals from government officials and the notaries must have mastered the professional knowledge and skill and obtained the qualification certificate of the notary. After the notarization law has been enacted, the notary system has basically formulated. There is few cases show how the notaries assume the civil liability for compensation because the notary system is not that completed. How to establish the civil liability system for the notaries that will be seasoned with the requirement of Chinese tradition is a problem to be solved in theory and practice and it has been paid much attention by the circles of the law theory and practical authorities of justices of China.The paper adopts the relevant methods, positive analysis, from shallower to deeper. First, it shows the history of the notary and the notary system. Then, with the beginning of the kinds of the legal liability for the notaries and the theoretical basis of the civil liability for the notaries, referred to the analysis and comparison of the civil liability for the notaries of the two legal families, from the point of the criterion of imputation, the formation, the share of the burden for the civil liability for the notaries, the thesis is aimed to discuss the shorts of the civil liability system in China, and gives some suggestion.
