Study Of The Perfect Path Of The Public Hearing System

In twenty century nineties, China brought "hearing"into the field of administrative penalties firstly and obtained great results and caused strong repercussions. Since that hearing system in China has developed rapidly. "Hearing"no longer only confines to the field of administrative punishment, but also extends to the field of in public administration, take price decision-making for example. However, due to complex relation in the field of public administration, there are many problems and so much controversy during the process of the public hearing's development. Compared with the administrative hearing, the scholars'attention on public hearing was relatively small.This paper uses the basic theory of public hearings as the starting point and applies multidisciplinary theories, like political science, law, and administration to analyze and research. Detailed analysis are as follows:The first chapter is to define the concept of public hearings, then analyses the theory origin and the functional position of public hearings. During the inspection, should distinguish"public hearing " and "private interest hearing"clearly at first, then settles the public hearing as " in the public administration process, when it comes to coordination of public interest or the multi-stakeholder ,the administrative authorities should listen to public opinions in the form of meeting procedures. "The second chapter analyzes the public hearing system's path of evolution, and through the study of the background and the public hearing's development in our country to analyze its legislative situation .And point out the main issues in three levels: external environment, system-building and practice.Chapter III proposes an improved path on the basis of the first two chapters. Compares domestic research with the research of western developed countries and learn their successful experience. We should pay attention to both of external environment protection and system self design. Improving the protection of external environment, we can mainly from the cultivation of social interest groups, development of civil society and the strengthening of information disclosure,"Sunshine government building"and so on. And on the self building of public hearings system, we should take the focus on the scope of public hearings, participants system and their specific procedures for construction of the system.
