A Study On Several Legal Problems Of Unilateral Free Trade Zone

With the continuous development of economic globalization, the Free Trade Zone has not well adapted to China’s economic development, people come to realize the bonded area to promote economic development and improve their competitiveness further, we must realize the transformation and upgrading of the Free Trade Zone. So, September 29th,2013, China (Shanghai) free trade test area (hereinafter referred to as the "Shanghai Free Trade test area") came into being. Shanghai Free Trade Zone is a free trade test pilot area of China’s first domestically built, it is different from China in the past to join bilateral or multilateral free trade zone, which is established within our borders, the unregulated and any other countries constraint. In order to facilitate bilateral or multilateral free trade area with such a free trade zone in the usual sense to distinguish, tentatively hereinafter called "the unilateral free trade zone", and make the bilateral or multilateral free trade zone, respectively. Unilateral free trade zone, refers to a customs in a country without borders established under the jurisdiction of the trade-based special economic zone. It is in a position outside the customs territory, the tax preferential policies, highly open and free, but you can not violate the basic principles of international law. Unilateral free trade zones generally have the following characteristics:First, within a country’s borders, by the jurisdiction of the government; second, have the status of the territory outside the customs, the customs of the country unregulated; third, to enter the zone goods given preferential tax relief; fourth, the main role is to be stored in the area of trade or export processing. Based on these characteristics, we can also see that unilateral free trade area with a high degree of openness, freedom of convenience and other features. A typical unilateral free trade zone in the world, such as free trade zones and in Hamburg, Germany on behalf of the United States in New York Harbor FTZ countries, representatives of developing countries, Panama Colon Free Trade Zone and Manaus FTZ of Brazil as well as representatives of emerging countries, Singapore free trade zones and Dubai free trade zones, they are elements of the government, the market, institutional, and human resources are in a relatively mature stage of development, has a very important reference for the construction of unilateral free trade zone. Shanghai Free Trade Zone is still in the experimental stage of initial development, all aspects are not yet ripe for the current situation, China’s construction of unilateral free trade zone need to transform government functions, innovative service management, improve the legal system, the implementation of open and favorable investment and tax policies, improve infrastructure, promote integrated logistics system, promoting the development of financial, information and other support services industry, innovative aspects of the existing system and so on to try to customs supervision.
