In recent years, the concept of sustainable development after extensive publicity, got more and more people identity, corporate social responsibility into the view of environmental protection concerns, including monitoring the environment responsibility of financial institutions in the boot bank borrowing enterprise environmental risk, reduce the enterprise’s environmental damage activities play an important role. In order to better solve the problem of severe environment, ensure the performance of the victim compensation, to establish and perfect our country commercial bank environment responsibility is imperative. At present, environmental responsibility system of USA commercial bank have good results. Though the law of commercial Banks in China environmental responsibility also have rules, but rules are scattered, lack in violation of the provisions of relevant punishment mechanism to ensure the implementation of legislation and practice overall is still in its primary stage, there is no a set of complete system of legal liability. Led to the current laws and regulations can’t effectively play a role, the rules to the implementation and broad issues such as liability regulations. Therefore, this article on the basis of using the experience of American lender environmental responsibility, discusses the improvement of the environmental liability system of commercial bank has practical significance.In this paper, based on the theory of corporate social responsibility, environmental community theory, risk society theory, using comparative analysis, value analysis and empirical analysis method, the full text besides preface and conclusion, mainly includes five parts:The first chapter is summary of environmental responsibility of commercial Banks. This part firstly expounds the connotation of the commercial Banks, and comparing with the concept of corporate environmental responsibility, environment responsibility has been clear about the commercial Banks compared with the uniqueness of corporate environmental responsibility. Secondly analyses the difference between commercial bank’s environmental responsibility has unique role in the corporate environmental responsibility.The second chapter introduces the commercial Banks to the basic theory of environmental responsibility. This part introduces the theoretical basis for the environment responsibility of commercial Banks have a corporate social responsibility theory, the environmental community theory, risk society theory from three aspects, this paper expounds the commercial Banks to the source of environmental responsibility.The third chapter analyzes the status quo and problems of our country commercial bank environmental responsibility. Commercial Banks in our country present situation and problems of environmental responsibility. This part points out our country environmental liability legislation in the commercial bank lack of rigid constraints, limitation of liability is not specific, the lack of incentive mechanism, the standard of the unified environment and perfecting the information disclosure of related supporting system support.
