The environmental pollution and resource waste caused by extensive economic development mode,which was adopted by high energy consumption and low efficiency,deviate from the requirements of sustainable development concept.Apart from simply using legal means to manage environmental problems,the use of financial means to regulate the impact of economic behaviors to environment is attaching more and more importance.The financial revolution with the theme "Green Finance" has become the development trend of the financial world.Green credit achieves the purpose of leading enterprises to protect environment through financing control of enterprise and project.Compared with single environment administrative punishment means,green credit scientifically deals with the relationship between finance and sustainable development,saves administrative costs,optimizes resource allocation and improves environmental protection efficiency.At present,using the law to regulate and guarantee the implementation of green credit and gradually build up legal systems for green credit has far-reaching significance for the coordination and implementation of environmental protection and economic growth.The paper is from legal perspective and learns from practical experience from foreign Equator Principles to explore issues related to the legalization of green credit,make it play the role of rational allocation efficiently and achieve the purpose of protecting environment by means of law.This paper is divided into four parts to study issues related to the legislation of green credit in China.The first part summarizes basic theories of green credit,including the definition of green credit,environmental economics law,legal theory foundations,etc.The second part introduces the international standards of green credit – the equator principles,including the development of equator principles,system framework,the main content and evaluation.The third part introduces the rules of our laws and policies to green credit and banking practice,and summarizes the major problems of green credit at present.The fourth part is specific suggestion of the establishment of legal systems for green credit.It firstly discusses feasibility of legalization of green credit,puts forward the form of "hard law-based,supplemented bysoft law" from the path of the legalization of green credit,and elaborates the specific content that legal systems for green credit have to improve.
