After the Copenhagen conference, Low-Carbon Economic has widely advocated by the international community. This new economic conforms to China's national interests, and it is conducive to the realization of Sustainable Development Strategy and even helpful for constructing the society which calls for resource conservation and environment friendly. In promoting the development of Low-Carbon Economic, our government should improve the relevant legislations, and particularly strengthen the macro-economic control according to the law actively. Standards of low-carbon and green production and life mode should be set up. The complete legal system of Energy Saving & Emission Reduction and the legal support mechanism also should be established.Researching laws on Energy Conservation & Emission Reduction Credit is an important issue about establishing a legal system of Energy Conservation & Emission Reduction. As environmental crisis become more serious day by day, our existing environmental laws and provisions which could regulate the enterprises'pollution behaviors show their limitations. As the concepts of Corporate Social Responsibility, Sustainable Development and Low-Carbon Economic growing vigorously, the environmental responsibilities of financial institutions have been concerned by the international community. In promoting the economic policy of environmental protection, our government realizes that the participation of financial institutions, especially commercial banks, is important in controlling the enterprises'environmental behavior. Banks'attitudes on environment are very important.Banks are the important power in financial development and they are in the center of the modern economy when they are servicing for the people and meanwhile running the credit, transmitting policies, and allocating resources, By the primary business of absorbing the social deposits, granting the loans and giving investments, banks guide social macroeconomic development when they are allocating the financial resources. As the lender, banks'consideration to environmental factors in their loans decision-making will determine the trend of financial resources and the adjustment of industrial structure. So banks'loans decision-making plays an important role in the sustainable development of environment, economy and society. In the same time, banks could increase profits through develop green financial products, and this activity could also bring more business opportunities for themselves. Comparing with the relatively mature legislation in abroad, policies of our country's Energy Conservation & Emission Reduction Credit has matured, so its legalization requirements are revealed gradually. Therefore, to research the legal issues of Energy Conservation & Emission Reduction Credit in China is in time.The dissertation is divided into seven parts to discuss the legal issues on Energy Conservation & Emission Reduction Credit which aims at implementing the"Green Credit Policy"in China: The introduction described the whole content briefly. In the first chapter, the meaning of Energy Conservation & Emission Reduction Credit and its law practice were summarized firstly. Secondly, put forward the existing problems of our own by comparing with the law practice between different regions and countries. The next four parts proposed legal countermeasures for the problems which were discussed in the first chapter. Interest relationships in Energy Conservation & Emission Reduction Credit are the logical starting point of this thesis. The author gave some thinking to the legal regimes which ensure the implementation of the Energy Conservation & Emission Reduction Credit efficiently.The epilogue summarized the thesis and selected the legislation model of Chinese Energy Conservation & Emission Reduction Credit. And the innovation points and limitations of this dissertation were given at last.
