A Study Of Retaliation Measures In WTO Dispute Settlement Mechanism

The dispute settlement mechanism of WTO forming from the Understanding on Rules and Procedures Governing the Settlement of Disputes, it is so important that which matters the operation of the system and the realization of the subject and the existence of the whole WTO system. DSU regulates three implementing measures, which are withdraw, compensation and retaliatory measures.The retaliatory measures is the final remedy of the dispute settlement mechanism of WTO and the last insurance for the members who want to settle disputes. According to the study of retaliatory measures’ history and basic ruling, adding to the 22 clause of DSU and the practice of retaliatory measures, which summed up the defects of retaliatory measures in substantive and process, the writer proposed perfecting suggestions. With the development of Chinese trading, as one of WTO member, China unavoidably involved in the retaliatory measures of DSU. A good study about retaliatory measures will help China make a better show when facing and applying retaliatory measures.
