On The Perfection Of Economic Compensation System In Labor Law

In recent years, Economic compensation is an important part of Chinese labor contract system, it playing an important role in the field of balancing conflicting interests.This paper introduces the basis theory of economic compensation in the first place, then the author discuss its legal basis and social foundations so that we can find out its true meaning. Then the author introduces some developed countries and Hong Kong of China and Taiwan of China’s economic compensation, we can find some legislation enlightenment. On the basis of the analysis, the author introduces our country’s economic compensation current legislation and the author point out the problem. Then this chapter talk about economic compensation applicable scope and distinguish the different between rescission and termination of contract. After that,the author discuss the payment theme of the economic compensation, it concludes payment standard and payment way. Above those problem, the author discuss the way to perfect the legislation on the basis of our country’s conditions, the way to improve the application of economic compensation, payment standard and payment way, the author give some suggestions to those problems.
