With economic development, the two-way choice between employers and workers are more and more. Accompanied by that, the both sides terminated the contract causing many problems. And due to the Economic crisis, more employers terminated the contract, which made the research on the economic compensation being more and more important.However, nature of economic compensation is no specific definition, the author attempts to localize the properties of economic compensation. On this basis, analyzing the existing laws is in order to find the shortcomings. Shortcomings mainly focus on these aspects: limits hurt the enthusiasm of high-wage workers. There is no a lack of minimum requirements. To levy taxes lack the basis and is illogical. To distinguish who propose consultation is unreasonable. Using some provisions of Economic compensation will appear unreasonable results, etc. In order to make our economic compensation system can be more perfect, the author gives the law rule about compensation in the overseas,HK,Macao and TW. It compares with the law rule in our inland and looks for some legislation enlightenment.
