Study On The Relevant Issues And Legal Relief Of Abandoned

Abandoned infants assistance is a social problem and the perfect degree of abandoned infants assistance system represents a country’s level of the rule of law, so it is crucial to use the rule of law means to control abandoned rescue. The current status of Chinese abandoned infants assistance exists some problems, such as body dislocation, legal lag,lack of supervision, chaos.Public relief relays on administrative system, which seems like a kind of assistance with the guarantee of national public power, but there are some problems such as relief pressure, regulatory failures, low aid quality and so on. Folk rescue is indeed strong supplements to public relief, but it suffers from no system to safeguard their legal subjective status. Folk rescue becomes a hotbed of crime because of the loss of its legal relief way and the struggling to supervision of government. Individual adoption in our country sets a very high threshold of "adoption law", in addition to complicated procedures,so that it is difficult to realize personal legal adoptions and illegal adoption becomes prevalent.This paper aims to find the problems, analyze the causes and put forward to the countermeasures. From the legislation, we perfect deficiency of law, modify the lag of law and advocate the national introduction of Pratt & Whitney type "welfare children act" in order to reduce the incidence of abandoned babies from the source. At the same time, we will give legitimate and effective participation way to the folk adoption and individual adoption. From the administrative system, we will strengthen coordinated arrangement of functional departments, make responsibilities clearly, clarify the relief program and increase the government’s macro-control ability in order to achieve effective remediation and supervision, prevent the occurrence of common legal risk and improve the abandoned infants assistance system.
