The Anti-thinking And Improving Of Child Welfare Legal System In Our Country

Child welfare starts from the protection of child rights, and provides assistance and protection for survival, growth and development of children. Child welfare legal system is a collection of principles and rules made by state and government aiming at meeting the needs of all children for better survival and development. This paper combs six periods of child welfare development since the founding of our country, sums up problems in the legal system of child welfare in principle, legislation, execution and substance fields, mainly including "the principle of best interests of the child" are not implemented; without a systematic child welfare legal system; lacking of unified, widely powerful child welfare administration institutions; incomplete of specific content of child welfare. And analyzes the reason socio-economic and conception dimensions. Binding extraterritorial legislation and experience, putting forward specific recommendations to improve our child welfare system, including establishing the concept of universal-type of child welfare; clearly establishing and carrying out "the principle of the best interests of the child"; formulating Child Welfare Law as soon as possible, the law must include the principle, object, content, the main responsibility, the administrations of child welfare protection, the basic system and measures of child welfare protection, the procedure to deal with child welfare cases; and legal liability of subjects relating with child welfare, etc; setting and forming a specialized, unified, powerful child welfare administration system, which is established on the coordinating agency consists by central and local Child Welfare Committee, the specific management agency consists by the National Child Welfare and local child welfare administrations at all levels. The anti-thinking and improving of child welfare legal system not only helps to improve the level of our child welfare, but also contributes to the protection of child rights and the healthy growth of children.
