A Comparative Analysis Of The Regulatory Mechanism Of Sino - American Charity Organization

Charities are the general term of the practice that social public, enterprises and institutions offer free aid to the vulnerable group. Charities are an important means to regulate social income distribution except the market and the government. Recently, with the ceaseless development and increasing number of Chinese charities, the organization and supervision of charities have caused extensive social concern. It is extremely urgent to establish and perfect a fair, honest and efficient organization and supervision mechanism of charities. There is an old saying "Stones from other hills may serve to polish the jade of this one." The long history of development of charity in the United States guarantees rich experience and has drawn the whole world’s attention in the achievements and excellence of supervision of charities, which deserves our respect and learning. In this context, this dissertation will make a comparative analysis about the similarities and differences between the Chinese and American supervision mechanism of charities. This dissertation focuses on the crosswise comparison on the legal construction, administrative supervision, interior governing, social supervision and other problems about charities and its supervision. We will find the drawbacks, learn from the strong and close the gap, broaden the horizon, strengthen the thoughts as well as analyze feasible routing selections for perfecting Chinese charitable supervision.This dissertation consists of five chapters. Chapter One is the relevant concept of dissertation design and theoretical basis. In this part, some essential conceptions will be defined, including charitable organization, charity supervision, supervision mechanism, and elaboration on the theoretical basis including civil society theory, responsible government theory and the new public service theory. Chapter Two will make a simple analysis about the Chinese charitable organization and the process of the discovery of its supervision mechanism. Besides, this chapter will emphasize the shortcomings of Chinese current charitable supervision mechanism. The third chapter will analyze the exploration of charities and the supervision mechanism in the United States and elaborate their worthy lessons. Chapter Four will compare and analyze the similarities and differences between the Chinese and American charities and the charitable supervision mechanism, especially the differences and the inspirations we can learn from that. The fifth Chapter will state some enlightenment we can draw from the comparative analysis about the Chinese and American charitable supervision mechanism and will propose some routing selections,including idea cultivation, system completion, location of the relationship between the government and the charities, inferior transparent work in charities and diversified supervision on charities.
