A Study On The Problems And Countermeasures In The Enforcement Of Forest Public Security Organs In China

The forest, as a part of important natural resource, not only has the effect of providing forest and forest products, conserving water and soil, but also has the effect of purifying air and regulating climate, that is why forest is called the natural oxygen bar. The forest has very important ecological value and is the important basis of human survival. But in recent years the crime of destroying forest, like felling trees, deforestation, altering or occupying land, illegal wood processing, illegal timber transportation etc happens frequently, also forest fires often occurs. The forest resources criminal activities are getting more serious, which has the following characteristics: diversified forms of crimes, more complex members and diversified motivation, etc. China’s forest is faced with the problem of serious pollution, destruction and waste. In order to protect the security of forest resources, China has promulgated a series of laws and regulations, such as Forest Law, Forest Law Implementing Regulations, Forest Fire Prevention Regulations, and established the forest public security organs dedicated to combating the crime of destroying forest resources. The majority of forest police faithfully perform their legal duties, crack down effectively on all kinds of the illegal activities of the destruction of forests and wildlife resources, and make a great contribution to the ecological construction and forestry development.However, the forest public security organs are also facing many problems in the process of law enforcement, including the problems of itself, such as the staffing composition is complicated, institutional settings are not standardized, police protection is not in place and so on, also the problems from outside, such as the problems of the right of law enforcement, the confusion of duty, the bad environment and so on. By analyzing the reasons of these problems, we can see the things that effect the forestry police’s law enforcement are: the laws and regulations for the protection of forest resources is not complete, the right of law enforcement and the law enforcement system are not completely straightened out, the law enforcement supervision is lack of effect and so on. These problems affect the law enforcement by forestry police, and influences the crackdown of forest resources criminal activities which is not good for protecting our country’s forestry. Therefore, in order to full play the role of forestry police of our country, we must perfect the legislation, focus on protecting forest resources ecological legal interest, increase the penalties to the damage to forest resources, and earnestly implement the enforcement power of forestry police, and straighten out the management system of forestry police, and improve the ability of law enforcement of forestry police, so that we can better play the effectiveness of forestry police. Hope these measures can enrich and develop the study on forest law enforcement of our country’s forestry police, and make a little contribution to the protection of forest resources in China.
